The triple Formula 1 world champion, Sir Jack Brabham and his family have confirmed today that they will take legal action against Formtech for using the Brabham name in its entry for the 2010 championship.
Formtech has submitted its application to the FIA under the name Brabham Grand Prix Limited and will find out in a few hours if it has been accepted by the governing body.
However, the Brabham family has clearly stated that it is not affiliated with Formtech’s potential entry. Furthermore, it confirmed today in a statement that it is considering legal action against the team using this famous name.
In an official statement, Sir Brabham declares on behalf of his family: « It was necessary to initiate legal action against Brabham Grand Prix Limited Formtech following its application to enter the 2010 Formula 1 championship. »
« The Brabham family made numerous proposals to Formtech to resolve the issue amicably. »
« In the absence of any response from the team, the family was left with no other alternative than to file a lawsuit in order to protect the family name. This comes regardless of the fact that Formtech may be held accountable by the FIA on Friday, June 12. »
« The name Brabham has always been owned by the family, and it is unfortunate that once again, steps are being taken to protect it. »
